Appeals
Planning refusals can be appealed to the Planning Inspectorate (PINS), a central government agency.
Ray Welsh has over 30 years experience of planning appeals. There are 3 methods:
- written representations — written statement and accompanied inspection of the site. This is the quickest and cheapest method
- informal hearing which also includes an informal discussion. It takes longer and is slightly more expensive but has a higher chance of success
- full public inquiry with advocates and cross examination. This is significantly more expensive but has the highest success rate
Ray has a high rate of success. We can advise on the most suitable method taking time, cost and outcome into account.
If the original assessment and application were well prepared, the prospects for success should be good. If a proposal is contrary to planning policy and there are no adequate justification for an exception the solution may be to submit an amended proposal which will have a greater chance of success. If this is the case, we will give that advice.
If a council is unreasonable, costs can be awarded to the appellant. Ray has achieved awards of costs in a significant proportion of cases.
